ORDINANCE 2011 – 07

AN ORDINACE ESTABLISHING BUILDING PERMIT FEES
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, ARKANSAS
SECTION 1. Every person, firm or corporation who intends to do any of the following activities must apply for a building permit. The building permit application must be turned into the City Treasurer with proper fee. The application will be filed in the office of the Recorder/Treasurer.
Building activities requiring a permit are as follows:
Any activity involving new construction of any structure.
Any activity involving a change of the existing footprint of any structure, including building additions, siding and porches.
Any activity involving the demolition of any structure.
Any activity in which proximity to property lines may be affected.
SECTION 2. Building permits are NOT required for the following activities:
Shingling, Painting, Any other activity considering being maintenance or repairing.
SECTION 3. Every application for a building permit shall show, by lot and block numbers and address, the exact location of such contemplated activity and the cost or value of the completed work. The building permit shall be issued upon the payment of the permit fee as follows:
All building permits will be $5.00 for the first $1,000 of cost and $2.50 per $1,000 of cost thereafter.
Demolition cost shall be the same rate as the building permits.
SECTION 4. The permit shall be posted in clear view at the building site prior to the commencement of construction.
SECTION 5. A permit issued by the City Recorder/Treasurer shall be valid for a period of 12 months from date of issuance.
SECTION 6. PENALTY. Any person violating the terms of this ordinance shall, upon conviction thereof, be punished by a fine not to exceed $1,000 or imprisonment not to exceed 30 days, or both such fine and imprisonment at the discretion of the Court.
SECTION 7. The 1999 State Fire Code is hereby adopted. (Code 2002, 11.20.01)
SECTION 8. The fire chief and or the chief of police and/or their representatives shall have the right, as it is their duty, to enter into and inspect any and all premises within the city at any time and as often as they see fit, and in the event the event any condition is found to exist which, in their opinion, increases the fire hazard and is dangerous, it shall be their duty to notify the owner of the premises to correct the same at once, but in the event that it is not corrected in ten days then the fire chief shall have the correction made and the cost shall be assessed against the owner of said property, provided nothing herein shall prevent the owner from appealing from the decision of the fire chief to the city council at its regular meeting. (Code 2002, 11.20.04)
SECTION 9. EFFECTIVE DATE. This ordinance shall be in full and effect from and after the date of its final passage and publication.
SECTION 10. REPEAL. This ordinance shall repeal ordinances previously adopted regulating the issuance of building permits and all ordinances in conflict with this ordinance.
